On Wednesday, May 20th, Eric Sarver, Esq. of The Sarver Law Firm, PLLC, had the pleasure of being interviewed by Bruce Hurwitz, of Hurwitz Strategic Staffing, for his show, “Meet The Experts.” We discussed employment law issues that employers and business owners face, as we prepare to reopen in the time of COVID-19. Ideal For Business Owners with Employees and Senior Level Company Management, I addressed the following topics:
(a) how to keep one’s business running while fulfilling their legal obligations as employers under the FFCRA, CARES Act and NYS Laws, as related to employees’ sick leave, emergency FMLA, or furloughing / rehiring of employees;
(b) what to know and understand about how employees’ requests around COVID-19 era accommodations, such as working from home, complaints about the workplace and COVID, or refusal to work, may implicate longstanding employment laws, such as the Americans With Disabilities Act (The ADA), The National Labor Relations Act (NLRA), and The New York State Whistleblower Protection Statutes and NYS and NYC Human Rights Law; and
(c) Employers and Business Owners learned the concrete steps to take, the responses to make, and the appropriate documentation to maintain or to ask for, in order to better insulate themselves from potentially frivolous or misconstrued claims by employees of alleged violations of the above listed federal and state laws.
